Relevant legal framework

Recognition and regulated professional access

  • Swiss regulated-professions framework — engineering is not subject to one general federal licence; whether recognition is legally required depends on the specific engineering activity and the canton in which it is exercised.
  • Agreement on the Free Movement of Persons (FZA, SR 0.142.112.681), Annex III and Directive 2005/36/EC, Arts. 10–14 — general recognition system for EU/EFTA qualifications where the engineering activity is regulated in Switzerland.
  • V-HFKG (SR 414.201), Arts. 55 ff. — national-law basis used by SBFI for recognition of relevant foreign higher-education qualifications from third countries where a recognition procedure is available.
  • Cantonal professional and building law — determines whether a civil-engineering or other engineering activity is regulated and which qualification, registration or signature requirements apply.

Professional practice in Switzerland

  • Non-regulated engineering activities — no formal recognition is legally required merely to work in the profession; a level certificate or academic recognition document may nevertheless be useful for employers, tenders or professional positioning.
  • Regulated cantonal activities — recognition and/or cantonal registration must be resolved before undertaking the reserved activity.
  • BGMD (SR 935.01), Arts. 1–4 — notification and qualification-check procedure for qualifying EU/EFTA service providers carrying out a regulated activity temporarily in Switzerland.

Competent bodies

  • SBFI — recognition where SBFI is the competent federal authority and guidance on the applicable route through the Swiss recognition framework.
  • Competent cantonal professional / construction authority — determines and enforces cantonal access, registration or signature requirements for regulated engineering activities.
  • Swiss ENIC / SBFI, depending on the qualification and purpose — academic or level documentation where the activity itself is not subject to formal professional recognition.
  • SBFI declaration centre — notification route for qualifying temporary EU/EFTA services in regulated activities.
